After several attempts to reach Rebecca Kafka by phone and email regarding Sharon's property that was on consignment at Becca Consign and Design located in Cumming, Sharon posted a message on the Becca Consign & Design Facebook Page about the whereabouts of her property. She also went to the local Sheriff's Office to file a Police Report. We were told it is a civil matter and we would need to file a case at the Magistrate Court.  Another consignor reached out to Sharon and together, they each had pieces to the puzzle. This other consignor hired a lawyer and learned Rebecca Kafka filed for Bankruptcy in which he and Sharon attended the Bankruptcy hearing on October 5, 2015. It was at this hearing that both Lawyers arranged a time for both Sharon and this other consignor to pick up their personal property and money that was owed to each of them.

We learned that she was evicted from her previous location: 1595 Peachtree Pkwy, Cumming, GA 30041. She claims she could no longer afford the rent increase, however, one of the reasons why she was evicted was due to not having proper signage in front of the building. You can read more about the signage through the Forsyth County Planning and Development page by clicking here. We have other documentation (not posted) showing she was evicted from this location. This paperwork states: "Debtor operated for 6 years and closed 8/25/15. It had consigned thrift used furniture sales. Debts greatly exceeded any assets. Debtor owned 100%. This business was evicted by the landlord. The consigned furniture was returned". I have many texts, emails, Facebook Messages from several consignors that state their furniture has not been returned to date!!!

She only has a three month lease at this "Hidden Location". When asked of Rebecca Kafka what will happen to all the furniture after the three month lease runs out, her response was: "The contract states: "If items are not picked-up within 10 days of the end of the consignment period, items become the property of Becca Consign & Design, LLC.". She stated: "I will donate these items after my lease runs out." I highly doubt she will donate any of these items. It is believed she is trying to sell consignors' property and keep 100% of the monies for herself.

The Forsyth County Code Enforcement Office has found Rebecca Kafka to be operating her consignment store business at this new "hidden" location: 4230 Canton Hwy. without having a business license. By not having this license, she now claims she will close her doors at this location on December 1. I wonder what will happen to all the consignment furniture that is at currently at this location??? She will probably move to another hidden location - possibly Florida where she wants to live one day. How very sad!!!

If you are owed property or money, you will need to go to the Cumming Magistrate Court to file a case (Probably cost around $110 to file). From there, the courts can then get the police involved. Both Sharon, Brian would be willing to go to court with you as a witness in this case.

If you are/were a recent consignor with owner, Rebecca Castleberry Kafka, and are a victim of her disappearing with your property, or monies owed to you from property sold - we have helpful information to help you retrieve what is yours!!! SHE CLOSED HER STORE WITHOUT CONTACTING ALL OF THE CONSIGNORS!!! I CONSIDER THE PROPERTY SHE HAS TAKEN (A STORE FULL OF BEAUTIFUL FURNITURE), TO BE STOLEN!!! She left no forwarding address, has not responded to phone messages, emails, etc. She was located at 1595 Peachtree Pkwy. Suite # 104, Cumming, GA 30041 in the Sharon Greens shopping center, near Papa John's pizza. We tried filing a police/sheriff report, but were told that we need to file a civil action (Magistrate Court). We were then in contact with another consignor who hired an attorney who informed him that Rebecca Castleberry Kafka filed for bankruptcy. I was able to learn of her "hidden/undisclosed location" prior to attending the bankruptcy hearing, held Oct 5, 2015 where we learned she is NOT ALLOWED to be operating her consignment business, ever again! She currently has furniture posted for sale on Craigslist - Cash & Carry only (no paper trail), has signage posted at the "new, hidden location", held an Estate Sale on Oct. 17, 2015, and is clearly trying to liquidate the inventory of furniture she has in her possession (it seems for her own profit ???) Cash & Carry only!

Becca Consign & Design has an "F" rating on BBB, with a history of complaints of bounced checks, not returning property, etc.

If you are a victim of her selfish actions, YOU MUST send her a Demand Letter / Notification Text, and/or a Certified Letter. I recommend both! These are documented, and offers you receipt of notification.
